The Women’s Affairs Unit at Al-Furat Al-Awsat Technical University, in cooperation with the Department of Business Administration, held a scientific course titled “Women’s Rights Between the Iraqi Personal Status Law No. 188 of 1959 and the Code of Sharia Rulings on Personal Status Matters According to the Ja’fari School.”
The lectures were delivered by Lect. Dr. Hassanain Ali Hadi, Lect. Ahmed Ghaffar Hussein, and Asst. Lect. Sara Alaiwi Abu Souda, who covered multiple scientific and legal topics.
The course topics included explaining the foundations upon which the Iraqi Personal Status Law No. 188 of 1959 and the Code of Sharia Rulings according to the Ja’fari school were established. It focused on how each addresses women’s rights at various stages of their lives, explaining the concept of justice and equity in both legislations, and the legal and Sharia philosophy on which each is based in regulating family affairs.
The course also addressed women’s rights in marriage regarding consent, dowry, and contract terms, alongside the husband’s responsibilities and duties toward his wife, with a comparison to what is stated in the Ja’fari Code. It highlighted divorce issues, its types, and women’s rights after separation, such as alimony and custody, and how the law protects her from abuse of power.
The topics also included women’s right to inheritance and its distribution mechanisms according to Iraqi law and the rulings of the Ja’fari school, explaining the points of agreement and difference between them. Additionally, it covered the role of the judiciary in applying these laws, guaranteeing women’s rights, and the challenges facing the practical implementation of these texts.
At the conclusion of the course, there was a discussion on the reality of women’s rights in society, the extent to which legal texts align with practical application, and the importance of legal awareness for women to enhance their ability to claim their rights within both the legal and Sharia frameworks.
